{"id":363,"date":"2016-09-01T10:30:37","date_gmt":"2016-09-01T09:30:37","guid":{"rendered":"https:\/\/hrteam2.grofuse.com\/?p=363"},"modified":"2022-09-30T11:15:35","modified_gmt":"2022-09-30T10:15:35","slug":"paternity-leave-in-ireland-and-what-it-means-for-employers","status":"publish","type":"post","link":"https:\/\/hrteamservices.com\/en\/paternity-leave-in-ireland-and-what-it-means-for-employers\/","title":{"rendered":"Paternity Leave In Ireland And What It Means For Employers"},"content":{"rendered":"<p>Paternity leave in Ireland is no longer a courtesy extended at the discretion of employers following the enactment of new laws today.<\/p>\n<p>Starting from today employers in Ireland can expect applications from fathers in both heterosexual or same-sex relationships for two weeks\u2019 paternity leave following\u00a0the introduction of\u00a0The Paternity Leave and Benefit Act 2016.<\/p>\n<p>That means that all employers should have paternity policies and procedures in place to ensure\u00a0employment law\u00a0compliance.<\/p>\n<p>It\u2019s important for employers to have all the answers to potential questions employees may pose by ensuring that policies and procedures on paternity leave are fully up to date and clearly communicated.<\/p>\n<h2><span style=\"color: #000000;\">WHAT PATERNITY LEAVE LAW MEANS FOR EMPLOYERS<\/span><\/h2>\n<p>The facts are quite straight forward. Statutory paternity benefit will amount to \u20ac230 per week &#8211; in line with maternity leave and based on the same PRSI contribution requirements. Under the new legislation new fathers are entitled to take two weeks\u2019 leave at any time within 26 weeks of birth.<br \/>\nFathers must provide four weeks\u2019 written notice of their intention to take paternity leave to their employer \u2013 although this may not apply in the cases of premature birth.<\/p>\n<p>Employers must remember that the granting of applications for paternity leave is no longer at their discretion. The law changes have been introduced as part of the Family Leave Bill.<\/p>\n<h2><span style=\"color: #000000;\">DO EMPLOYERS TOP-UP PATERNITY LEAVE?<\/span><\/h2>\n<p>Employers will have the option as with maternity benefit of \u2018topping up\u2019 the statutory paternity leave payment, in which case the payment can be made into the employer\u2019s bank account. Topping up the statutory payment is not a legal requirement although some employers may choose to offer this benefit.<\/p>\n<h2><span style=\"color: #000000;\">PATERNITY LEAVE IN IRELAND &#8211; QUICK TIPS FOR EMPLOYERS\u00a0<\/span><\/h2>\n<p><strong>1 Terms and conditions<\/strong><br \/>\nIt is essential that employers ensure that this new legislation is outlined in the employees\u2019 terms and conditions of employment. This should cover who is entitled to leave, when they can take the leave and the conditions for complying with legislation.<\/p>\n<p><strong>2 Communication<\/strong><\/p>\n<p>Communication: This is positive news for employees we would therefore advise that employers are informed of the benefits of this legislation to them.<\/p>\n<p><strong>3. Mindful of pitfall<\/strong><br \/>\nEmployers should be mindful that they do not fall foul of discrimination legislation when introducing a paternity leave policy.
