Business owners in Ireland and other countries are beginning to feel the economic impact of the spread of coronavirus.<\/p>\n

The rise in the number of confirmed cases has seen the stock market plummet. Its impact on the tourism industry and the slowdown in production in China has hit many Irish businesses hard.<\/p>\n

HR Team partner with one local company who have had to put 50 employees on temporary leave until May because 80% of their business comes from Asia.<\/p>\n

More companies will be faced with having to lay off employees.<\/p>\n

However, it is important that employers are aware of the law around employees\u2019\u00a0rights, notice period, contracted working hours and pay should they need to implement drastic measures.<\/p>\n

HR Team Director,\u00a0Breda\u00a0Cullen, says:\u00a0\u201cEmployers\u00a0can enforce short time working by putting an employee on a reduced working week or they can lay them off.<\/p>\n

\u201cBoth of these\u00a0measures\u00a0are only temporary given there is a\u00a0downturn\u00a0in\u00a0business\u00a0or a\u00a0shortage\u00a0of\u00a0work.<\/p>\n

\u201cIn\u00a0order\u00a0to\u00a0enforce either measure, it\u00a0has\u00a0to\u00a0be\u00a0a contractual agreement with the\u00a0employee.<\/p>\n

\u201cA\u00a0lot\u00a0of\u00a0employers\u00a0will not have that contractual agreement.\u00a0This is quite relevant at the\u00a0minute\u00a0as the virus continues to spread.\u201d<\/p>\n

Ms Cullen says employers\u00a0will\u00a0need\u00a0to\u00a0have a robust contingency plan to\u00a0deal\u00a0with the direct and indirect impacts of the virus.<\/p>\n

\u201cZero hour\u00a0contracts\u00a0are\u00a0permitted\u00a0in Northern Ireland.\u00a0However, if an employer has a member of staff on a\u00a0zero-hour\u00a0contract\u00a0but they receive hours every week the\u00a0contract\u00a0can become difficult to\u00a0enforce,\u201d\u00a0she says.<\/p>\n

Is an\u00a0employer\u00a0entitled\u00a0to\u00a0lay\u00a0off\u00a0staff\u00a0in the\u00a0interest\u00a0of their\u00a0safety?<\/strong><\/p>\n

Although it may be detrimental to the economy, workplace health and safety may need to be prioritised. Measures could include closing down business premises temporarily, Ms Cullen says.<\/p>\n

\u201cIn the\u00a0interests\u00a0of\u00a0keeping\u00a0their\u00a0employees\u00a0healthy\u00a0and\u00a0safe, \u00a0employers\u00a0might possibly\u00a0need to\u00a0close\u00a0their\u00a0business.<\/p>\n

\u201cFor\u00a0example,\u00a0if\u00a0an employee is confirmed to have coronavirus, employers\u00a0must\u00a0seek\u00a0advice immediately from the public safety authorities.<\/p>\n

\u201cA risk assessment will be carried out to\u00a0examine\u00a0the contact sequence\u00a0if\u00a0a\u00a0case\u00a0has been\u00a0identified.\u00a0If\u00a0in that\u00a0case,\u00a0employers\u00a0are being advised to\u00a0close\u00a0their\u00a0business,\u00a0there\u00a0is no\u00a0real\u00a0legal\u00a0right to\u00a0pay.<\/p>\n

\u201cIf\u00a0the authorities have not advised that course of action and a business closes anyway,\u00a0employers\u00a0may be\u00a0obliged\u00a0to\u00a0pay\u00a0their\u00a0employees\u00a0as\u00a0there\u00a0is\u00a0insufficient rational for the action.<\/p>\n
